New bill in WY would make BAC testing mandatory for suspected drunken drivers
In the past 50 years, drivers suspected of drunken driving could refuse a breath test if stopped by police. That will change under House Bill 29 which requires suspected drunken drivers to take a blood-alcohol test. Penalties for refusal could result in as much as an 18 month license suspension. The new legislation targets repeat offenders with high BAC levels who know the law and its loopholes. In Teton County, WY the testing refusal rate is about 75 percent among people who are stopped for a second or subsequent DUI.
