VA Increases Teen Drunken Driving Penalties
The Governor of Virginia recently signed into law a measure to make drunken driving under age 21 a Class 1 misdemeanor- which is the same crime as underage possession of alcohol. The new law applies to drivers under 21 stopped with a blood alcohol content of 0.02 or higher. Under the new statute, young people convicted of underage drinking and driving must forfeit their license to operate a motor vehicle for one year and either pay a mandatory minimum fine of $500 or perform 50 hours of community service. Previously, underage drunken driving was a violation that could result in a six month license suspension from the conviction date and a maximum fine of $500. Alcohol possession by someone under 21 is also a Class 1 misdemeanor –punishable by up to one year in jail and a $2,500 fine. The new law becomes effective July 1, 2011.
